DALLAS (AP) ��Mark Cuban is expected to testify Thursday in the government's insider trading lawsuit against him, which could come down to whether jurors believe the billionaire and Dallas Mavericks owner's account of a 2004 phone call.

Cuban is likely to say that he never promised to refrain from selling his shares in an Internet company after learning news that would cause their value to fall.

The CEO of the Canadian search-engine company says Cuban agreed at the start of the phone call that he would be learning confidential information. When Cuban learned about Mamma.com's plan to issue more stock ��lowering the value of Cuban's 6% stake ��he got angry.

"Now I'm screwed. I can't sell," Cuban said, according to Guy Faure, whose testimony was recorded in late 2011 and played Wednesday for the jury in U.S. district court in Dallas.

    The biggest concern here is that 2013 has been a terrible year for oil-by-rail; the recent disaster in Canada isn't the only derailment. Canadian Pacific (NYSE: CP  ) had three derailments involving oil tank cars in the first four months of this year. One of the accidents, in Minnesota, resulted in 30,000 gallons of oil being spilled. It remains to be seen if these spills will be the tipping point for the approval of additional pipeline projects.

    For most farmers, one nutrient just isn't enough. A nutrient that has paired well in the fields with potash is nitrogen. Companies producing nitrogen-based fertilizers have been experiencing excellent margins over the last year thanks to cheap feedstocks provided by North American natural gas. With more than 80% of its revenue stemming from nitrogen fertilizers, CF Industries (NYSE: CF  ) turned in a return of 32% in 2012, well above the 11.7% of the S&P 500. Unfortunately, natural gas prices have risen and likely pressured the stock a bit lower. Year to date, shares have underperformed a hot market by 18.6%. One thing investors should look for here is higher-than-expected demand because nitrogen's supply and demand balance is much tighter than that of potash. If this takes place, prices and, in turn, nitrogen fertilizer producers' stock will likely rise.

    Mosaic (MOS), Agrium (AGU), Intrepid Potash (IPI) and CF Industries (CF) have been moving and trading hand-in-hand, with AGU, BHP and Rentech Nitrogen Partners LP (RNF) trading the best, losing the least and rebounding the most since July 30th. IPI has sold off a lot more in the post-news period, as would be expected from a smaller, less established company with mine projects still in development. BHP Billiton Ltd. (BHP) announced plans to proceed with its Jansen Mine Project in Saskatchewan, Canada, potentially tapping the largest and longest-lasting supply in the world known at this time. Scotiabank (BNS) recently commented on Jansen, stating that the added supply "could add the equivalent of 18%-20% of the potash market over recent years." Nearly all of the companies mentioned have had a pretty predictable mix of upgrades and downgrades. That's what makes a market.

    Rentech (Nasdaq: RTK) has been around for more than a decade, and it has shifted strategies several times. Full disclosure: Rentech’s Chief Technology Officer Harold Wright is a former manager of mine when we were both at ConocoPhillips, and I have visited Rentech’s facility in Commerce City, Colorado.

    For most of Rentech’s existence, the company has sought to commercialize alternative fuels. At one time it had ambitions to build a large coal-to-liquids (CTL) plant, but federal legislation ultimately nudged it instead into the biomass-to-liquids (BTL) space. The company did build a BTL demonstration plant, but ultimately shut it down and has now refocused its efforts on becoming “one of the largest wood processing companies in the world.”

    During its interesting journey as a company, Rentech acquired two ammonia nitrogen fertilizer facilities, which turned out to be a profit center that funded the alternative energy research. In November 2011, Rentech spun off this fertilizer business into an MLP called Rentech Nitrogen Partners LP (NYSE: RNF).

    In the months leading to the spin-off, RTK’s market capitalization was about $200 million. Rentech maintained 60 percent ownership of RNF, and three months after the spin-off RTK’s market cap had risen to $400 million, while investors had bid RNF up to $1 billion. Interestingly, RTK’s share of RNF was worth more than RTK’s entire market cap, a situation that persists.     Historically the stock prices of Deere (DE) and other agricultural equipment firms and retailers like Case-New Holland (CNH), Titan Machinery (TITN), AGCO (AGCO), Tractor Supply (TSCO), Valmont (VAL), and Lindsay (LNN) have tended to closely track the price of corn. When corn prices go up, farmers tend to make more money, and they spend that money on new equipment from Deere and other firms. This relationship is especially strong for Deere and Corn, but it holds true for all of the stocks above to some extent.
